In India there are at present five systems (1) Govt.Recognized system, (2) Govt. Restricted System (3) Govt. Derecognized system (4) Govt. rejected systems and (5) system of medicines not even considered for discussion of recognition.  Any systems prevailing and practicing in any part of the world is not your concern.

Whereas the following medical systems are the only recognized systems by the Government of India, State Governments and Union territory in India vide Ministry of Health & Family Welfare, Govt. Of India Order No. R.14015/25/96-U&H(R) (Pt) dated the 25th November 2003 enacted and promulgated under the Honorable Delhi High court Order.  No other systems are recognized. Practicing any other system is an offence in India. The eligibility to practice the system is shown against the system. The degree must be from a recognized institution.

I.  GOVT. RECOGNIZED SYSTEMS OF MEDICINES are shown below in (i) and (ii)   

   (i) Modern system of Medicine  

                   1. Allopathy                  : The Minimum qualification prescribed to practice is MBBS

   ii) Alternative System of Medicines   

                        2. Ayurved                : The Minimum qualification prescribed to practice is BAMS   

                        3. Homoeopathy       : The Minimum qualification prescribed to practice is BHMS  

                        4. Siddha                 : The Minimum qualification prescribed to practice is BSMS  

                        5 .Unani                   : The Minimum qualification prescribed to practice is BUMS  

                        6. Yoga & Naturopathy: The Minimum qualification prescribed to practice is BYNS  

Only these medical graduates of six systems can prefix Doctor with their name apart from the doctorate conferred on an individual by a recognized University. The eligibility and qualifications to practice any of the above system were confirmed by Ministry of health Lok Sabha and Central information Commission.   Practicing any other system is an offence punishable under various sections of IPC and consumer protection Act. 

All the clinics are to be registered under Clinical Establishments (Registration and Regulation) Act, 2007. Whoever carries on a clinical establishment without registration  under this act shall, on conviction for first offence, he punishable with a fine up to fifty thousand rupees, for second offence with fine which may extend to two lakh rupees and for any subsequent offence with fine which may extend to five lakh rupees.

II.  GOVT.RESTRICTED SYSTEM OF MEDICINES are shown below in (i) and (ii)  

(i)          Acupuncture      (ii) Hypnotherapy

Like restricted holidays are restricted to special community or religion, these two systems of therapies are restricted to medical graduates of six systems. These two therapies are not recognized but recommended to be qualified as modes of therapy to be practiced only by the Medical graduates appropriately trained namely in Acupuncture and Hypnotherapy.  

Health Ministry has revealed that only registered medical practitioners could provide therapeutic services for disciplines like acupuncture and hypnotherapy considered to be mode(s) of therapy can only be provided through certificate courses for registered medical experts, who can utilize that knowledge in their regular practice, be it connected to allopathy, ayurved  or homoeopathy, in their order No. R.14015/25/96-U&H(R) (Pt) dated the 25th November 2003.

1. Acupuncture: The minimum qualification prescribed to practice acupuncture is MBBS, BAMS, BHMS, BNYS, BSMS, BUMS with a qualification in acupuncture from a university approved by Govt. of India like Annamalai University, IGNOU. Annamalai University conducts a course in Acupuncture the eligibility being Medical graduation. IGNOU is conducting acupuncture course, eligibility being medical graduation. A medical graduate has to practice this along with his system only and not as separate System. Certificate from Sri Lanka or China not accepted.  

2. Hypnotherapy: The Ministry of Health, Govt. of India has confirmed through Central Information Commission that the qualification prescribed to practice Hypnotherapy is (1) MBBS (2) Clinical Psychology (3) degree in Psychology  (3) degree in recognized Alternative Medicines BAMS, BHMS, BNYS, BSMS, BUMS or (4) B.Sc (Nursing) with an additional qualification in Psychology from a recognized University. A medical graduate has to practice this along with his system only and not as separate System. Foreign degree and quackery degree not accepted.

Medical graduate having the following additional qualification is classified as appropriately trained.

i) M. Sc.(Psychology) M.A (Psychology) M.Phil (Psychology) courses of  University of Rajasthan, Banaras Hindu University,  Bharathidassan University, Bangalore University or any other recognized University in India.

ii) M.Phil (Clinical Psychology) of The Rehabilitation Council of India. 

iii) Diploma, PG Diploma in Clinical Applied Hypnosis from Maharaja Sayajirao University, Delhi University or any other University.  

MS, M.Sc, MPhil or PhD from unrecognized or online self-styled universities in India is legally liable under various sections of IPC.  (And consumer Protection Act if they have charged any fees). Any Foreign qualifications including clinical psychology or social work whether residential / correspondence / or honorary have no legal validity in India if it is not recognized by UGC or Rehabilitation Council of India.  

 III.   GOVT. DeRECOGNIZED SYSTEM OF MEDICINES are shown below in (i) and (ii) 

 i)    Electropathy         (ii)  Electro Homoeopathy

These systems of medicine were once recognized by Govt of India and all State Governments. There were or still there are about 700 colleges and a few universities of this system. After derecognition all the approved colleges and Universities of these systems are closed down. The doctors of Electropathy and Electro Homoeopathy were removed from their Service and now they cannot prefix doctor. They filed a petition in Delhi High Court. As per the Honorable Delhi High Court Orders CWP No.4015/96 & OM NO.8468/97, dated 18.11.98,  which has inter-alia, directed the Central / State Govts., to consider making legislation to grant of licenses to the existing and new institutes etc. to control & regulate the various "unrecognized" streams of alternative medicines and also to give adequate publicity through media informing public about the 'Respondents' and similar other institutes for being recognized by the Govt. & affiliated with any of the Councils.

Now Electropathy & Electro homoeopathy Status is  DERECOGNIZED  

 IV.    GOVT. REJECTED  SYSTEM OF  MEDICINES are shown below in 1 to 10 

The following therapies specifically came for scrutiny of the committee and they ruled these cannot be recognized or practiced by any one. Hence stands rejected. This is a law passed by Parliament.  

                      1.  Aromatherapy     2.Autourine  Therapy     3.Colour  Therapy

                      4. Gems & Stone Therapy 5.Magnetotherapy 6.Music Therapy

                      7. Pranic Healing  8.Reflexology  9.Reiki and 10.Urine Therapy   

The above ten therapies are practiced extensively in many countries.  But you cannot ask that why you cannot practice it here. There are a few hundred alternative therapies existing in India; none of these can be practiced in India as it constitutes an offence. There are expert Ayurved Baidyas, Hakims, Sidhars traditionally trained but they are legally liable. As long as there is no complaint, they may practice. There are many other systems of medicine in this country like Grandma Medicines, home remedies, herbal remedies, Mantra healing etc which are found to be effective. If you administer any such medicines to your child, no body will question you. But if the child is dead, you are liable to be prosecuted for the willful death of the child.

V.     SYSTEM OF MEDICINES NOT EVEN CONSIDERED FOR DISCUSSION OF RECOGNITION.

The following systems were not at all considered even for discussion.  Hence no one can practice these systems also.    Alexander Technique, Applied kinesiology, Aromatherapy, Astrology, Bach flower remedies, Body work, Chelation  therapy, Chiropractic, Chromo therapy, Craniosacral Therapy, Crystal healing, Emotional Freedom Technique, Feldenkrais method, Ion therapy, Iridology, Massage therapy, Nambudripad Allergy Elimination Technique, Neuro-Linguistic Programming, Polarity therapy, Radionics, Rebirthing-Breath work, Reflexology, Rolfing, Shiatsu, Therapeutic Touch, Thought Field Therapy, Trager Approach etc.

You may note some universities are giving degree in Astrology. Chelation therapy, EFT, NLP, TT, NAET is widely practiced. You cannot practice it here because you are not a qualified practitioner and the system is not recognized here. I wanted you to know that  mainly Acupuncture, Ayurved , Siddha, Yoga, Applied kinesiology, Chiropractic, Nambudripad Allergy Elimination Technique, Reflexology,  Reiki, Therapeutic Touch, Traditional Chinese Medicine, Traditional Tibetan medicine  and many other systems  are practiced all over the world and they all have a base concept i.e. physical body, subtle bodies, 7 Chakras, Kundalini, 14 Meridians, in common. But not in Allopathy and Homeopathy.

Now Government of India has abolished 44 deemed universities.  There are also a number of fake universities and colleges in all the states.  They have syllabus, teach theory and practice and issue certificates. Learning any such system is not an offence.  Teaching any such system for the spread of knowledge is not an offence.  Practicing on public is an offence because public Health is not your concern but the subject of the State and Centre. Charging for such treatment is also an offence.

Some fake schools/universities are awarding MBBS (AM), MBBS (Bio) similar to Modern medicine. Some fake schools are awarding degrees claimed to be equal to MBBS.  In Madras there is a school which imparts the knowledge of allopathic medicines. There is another famous school in Madras teaching Siddha system. There are Ayurved courses, Homeo courses, Yoga courses and Naturopathy courses.   Similarly there are individuals and institutions teaching and awarding Hypnotherapy degrees and certificates. Some are awarding PhD without any research work for a certain amount. Keep these certificates laminated safe in your box.

Many Electro Homeopathy institutions, hypnotherapy institutions and quack hypnotherapists are exploiting and fleecing the gullible quoting the Govt. Of India Order No. R.14015/25/96-U&H(R) (Pt) dated the 25th November 2003 &&. ELECTRO HOMEOPATHY IS RECOGNIZED    or   HYPNO THERAPY IS RECOGNIZED.  They will also fool you by telling that British Medical Association and American Medical Association have recognized Hypnotherapy as a scientific mode of therapy. Though it is correct, Medical doctors and dentists are only authorized to practice it. Practicing or experience in a particular art or science is not a passport to cheat others. I feel these cheats have not understood the meaning of the above order, or pretending as if not understood or willfully twisting and interpreting to their benefit with an intention of cheating the gullible to have lively hood.

If Ayurved is recognized, an experienced ayurved baidya cannot practice it but a BAMS can. If Homoeo is recognized, that can be practiced only by a BHMS, not by a lay homeopath. So is the case with Siddha, Unani or HYPNOTHERAPY. Understand?   Do not quote British Medical Association, American Medical Association and Ministry of Health Government of India. It is of course recognized not for you or your practice but for the practice of medical graduates. Do not pause you are equivalent to a medical graduate.  To treat a patient you must know physiology, anatomy, endocrinology and psychology. You may treat appendicitis as stomach ache and brain tumor as headache and the patient will die. You are gambling with a life. Without knowing pathology, psychopathology, clinical picture, etiological factors and prognosis, how can you to treat a patient. Even for simple counseling, you must have counseling skills.

HYPNOSIS is not a panacea.  It is not a permanent cure. It has its own limits.  Every one cannot be hypnotized.  Even if hypnotized he may/may not go in deep state.  No organic disorders can be treated by suggestion. Even if a Neurotic patient can be hypnotized only Phobias and conversion disorders can be treated. Other Neurotic disorders require medicines. An unwilling person cannot be hypnotized. A person who is too drunk cannot be hypnotized. A person with extremely low intelligence, typically scoring an IQ level lower than 70cannot be hypnotized. Too aged people cannot be hypnotized.  Children with Attention Deficit Syndrome cannot be hypnotized. It is not possible to hypnotize people with Organic Disorders, Organic or functional Psychotic Disorders especially unresponsive Catatonic patients.  Hypnosis is not a substitute for medical, dental, or psychological treatment.  Hypnosis will not modify a persons acceptance of new ideas or behaviors that conflict with their personal values.  A person under hypnosis can lie and will not disclose anything if it threatens his existence or survival. Hypnosis cannot be used to control some one elses mind or their actions.  Then why hypnotherapy? Why Freud left Hypnosis? Hypnotherapy must be practiced only by Psychiatrists not by any lay hypnotherapists. Psychiatrists can hypnotize even any unresponsive catatonic schizophrenic patients within 6 seconds with Sodium Amytal or Sodium Pentothal and can have an effective rapport. This cannot be done by medical graduates of Alternative Medicines. Psychiatrist can apply Carotid Artery technique, shock techniques and Nerve Cluster Pressure Point techniques. No one else can do that.  Chemicals are to be used only once and consequent sessions can be done by Post Hypnotic Suggestion.

When Govt. of India or any other State Govt. has not approved hypnotherapy  and has warned the public to report such cases to take stringent action, how Sivanand or his Institute  advertise that he and his institution is recognized by Govt. of Delhi   Recognized by Central Govt.  Recognized by CBI and Delhi Police, Recognized by AIIMS. These people are professionally and academically not qualified but dare enough to teach and conduct classes and purchase degrees from India and Abroad for selling to gullible for huge amounts. This sort of bogus shameless claims and business are not only in Delhi but every where in India. They also pose as Past Life Regression Therapist,   Spirit Release therapist, Reincarnation therapist, Hypno analyst, Forensic hypnotist etc.  It might be true some investigating agency might have asked him some doubt. You may file a petition to the Delhi Police or to The Advertising Standards Council of India, 219, Bombay Market, 78 Tardeo Road, Mumbai 400 034 or to MRTP Commission, #28/3925, 103 Padam Singh Road, Karol Bagh, Delhi -110005 with a copy  to Health Ministry. You can also send an advocate notice or ask the government to reply (Right to Information Act) under what Act he was recognized and why action should not be taken against the concerned official.   If nothing works out, file a writ petition in Delhi High Court. They must be exposed and brought to books. As per PLR therapists/ SR therapist Asthma is caused because the patient was dead by drowning in his previous birth. This is for the information of the general public that in compliance of order dated 18.11.1998 passed by Honble High Court of Delhi, Ayurved , Siddha, Unani, Homoeopathy and Yoga & Naturopathy were found to fulfill the criteria for recognition. The Systems of therapies mentioned hereunder are not recognized therapies viz. Electropathy/ Electro homoeopathy, Acupuncture, Magnetotherpay, Reiki, reflexology, Urine Therapy/ Auto urine Therapy, Hypnotherapy, Aromatherapy, Color Therapy, Pranic Healing, Gems & Stone Therapy and Music Therapy.

In view of the above it is hereby made clear that those persons who are doing practice in any of the unrecognized Pathies shall be suitably dealt with under the relevant provisions of law. In case of any complaint, the public is advised to approach the Deputy Commissioner/ Senior Superintendent of Police of the concerned district.

You might remember that Reiki and Hypnosis known under the label Mantra therapy was introduced here in one of our Government run Medical College by Delhi Government and Rajasthan Government. The department of Mantra was abolished and many so called hypnotherapists were locked behind bars by the Delhi High Court Order in a midnight blanket sweep.

 My Sincere Advice to Everyone:  Do not distort any law to your benefit. You may open a Spiritual Centre.  Do not go against local authorities, police or politicians. Send a copy of this letter to your associations and to all your friends.

   Facts are as under:-
   (a) According to the directions of Hon'ble Delhi High Court in the matter of FAO No. 205/92 dated. 18.11.1998 NEHM of India is empowered to issue diploma/certificate and holders of it are entitled to practice in the system on the strength thereof.  Hon'ble Supreme Court of India has reaffirmed it and even delhi government in correspondence with union of india has issued a notification.
   (b)  NEHM of India filed a fresh petition in the Hon'ble High Court of M.P. Challenging the orders dated. 25.11.2003 of Union of India.  The Hon'ble High Court ordered that the peititioners cannot be stopped from carrying out the practice and imparting education in alternative system of medicine in view of the article 19 (1)G of the constitution of India.  Hence the action of the respondents in stopping the petitioners from practicing in alternative system of medicine or imparting education in the same is illegal and therefore the consiquential action taken by the respondent (Union of India & state government) are ule ltra vires.
   (c)  The Hon'ble high court of allahabad has while  disposing the 17 years old writ petition on 3.8.2009 directed the Union of India that the authority will consider and decide the matter for recognition or BEMS course run by the petitioner within 6 month.
   (d)  on writ petition filed by electropathy practitioner (Arvind Kumar Sharma qualified from and registered with NEHM), by Hon'ble Supreme Court of India, issued a notice to the respondents and granted stay against the proceeding being taken by CJM Aligarh.
   (e)  Recently on 25.1.2010 Hon'ble High Court of Kerala (Division Bench) has allowed the petitioner (practitioner) a qualified from and Registered with NEHM to practice in the system.
   Please do attention towards the naforious persons who do not want to recognised the system always trying to misguide the persons about the promotional activites of NEHM of India.  Hence beware from such persons.
